General Terms and Conditions of Center of Mental Excellence GmbH

By registering for the respective seminar, curriculum, module series, or other offers from CME in the field of further education and training, you agree to these General Terms and Conditions. CME concludes contracts and agreements based on these T&C as well as the advertisements for the respective curricula and seminars.

Registration

The reservation of participant places is based on the order of registration and payment. CME is entitled to reject individual participants without giving reasons or to exclude them from further attendance at the seminars/further training for important reasons.

Please refer to the details for the respective curricula and seminars for further registration conditions.

 

Cancellations and Rebookings/Cancellation Policy

Cancellations and rebookings must be made in writing and are possible via email or post.

The registration is binding and entails the conclusion of a contract. For a withdrawal after registration, cancellation fees will be incurred in the following amounts:

  • -Free cancellations are possible within 14 days of registration (right of withdrawal), provided that the further training does not, as agreed, already begin within 14 days after registration.
  • -After the contract is signed, 50 % of the participation fee must be paid.
  • -In the event of cancellations within the period of 6 days before the start of the seminar up to the day of the seminar, or in case of non-attendance without cancellation, 100 % of the seminar fee must be paid.

The above-mentioned cancellation fees apply regardless of the reasons for the cancellation. The date of cancellation is deemed to be the time at which the written cancellation is received by CME.

 

Right of Withdrawal

For distance selling transactions, the following applies: You have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period is 14 days from the day of registration (corresponds to the conclusion of the contract).

To exercise your right of withdrawal, you must inform us, Center of Mental Excellence GmbH, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, a fax, or an email). To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and at the latest within 14 days from the day on which the notification of your withdrawal from this contract is received by us. For this repayment, we will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.
If you requested that the services should begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal in respect of this contract, compared to the total scope of the services provided for in the contract.

 

Seminar Cancellations and Changes

CME is entitled to cancel the seminar or the curriculum if the number of participants is too low or for other compelling reasons (e.g., cancellation of lecturers due to illness if no replacement lecturer is available at short notice). Participants will be informed immediately in these cases. Seminar fees already paid will be offset against units that may have already been consumed. Insofar as parts of the fee (especially in the case of curricula) have not yet been consumed by attending events, a pro-rata refund will be issued or, upon request, the amount will be credited to another seminar. No reimbursement of travel and/or accommodation costs or other expenses will be made.

CME takes legal regulations and quality standards into account. It reserves the right to make changes to seminars with regard to content, seminar duration, location, date, and price compared to announcements and seminar programs.

 

Seminar Duration

The seminars take place for the duration of the specified units of 45 minutes each. The specified seminar time must be observed by both the lecturers and the participants.

 

Seminar Fee

The seminar fees are listed separately for the respective events. The listed fees include the costs for seminar materials as well as refreshments during breaks.

 

Terms of Payment

The total participation fee for the course, including all services to the announced extent, is due immediately upon receipt of the invoice. For organizational reasons, a place on the course can only be guaranteed after receipt of the participation fee. Please therefore transfer the invoice amount before the start of the course.

Unless agreed otherwise, all amounts are due for payment upon receipt of the invoice. Discounts cannot be deducted. Installment payments are not provided for. A pro-rata calculation of the participation fee does not take place. No reduction in the participant fee is possible, neither for a later entry into the course nor in the event of termination or early departure.

In the event of default in payment, we will charge all actual reminder and collection expenses as well as 12% default interest. The place of jurisdiction and performance is Innsbruck. Exclusively written agreements apply. Verbal collateral agreements are not legally valid. Employees of CME are not authorized to make verbal contractual statements.

 

Tax Deductibility and Financial Support Opportunities

Expenses for professional further training can be claimed as income-related expenses (employees in the course of employee tax assessment) or as business expenses (self-employed in the course of the income tax return). CME seminars are professional further training for specialist experts; the corresponding invoices or payment receipts serve as proof for the tax office or accounting department.

 

Certificates, Transcripts and Confirmations

We will send you the respective certificate / confirmation of completion / transcript for completed seminars/further training at CME in printed form by post and/or electronically. The prerequisite is that the participation fee has been paid in full and you meet the required completion criteria specified in the respective curriculum or event description (e.g., minimum attendance requirement, any required additional e-learning courses, final reports, etc.).

 

Data Protection

The privacy policy published on the CME homepage is deemed agreed upon.
